At ABA Law Office, we are proud to share a significant development in a first-of-its-kind matter concerning the Indian Air Force and disability pension claims.
Our Principal & Founder, Ms. Anushkaa Arora, appearing as Senior Panel Counsel, represented the Union of India in a writ petition challenging the Armed Forces Tribunal’s order granting disability pension.
What made this case unique was that it stemmed from a batch of over 200 similar petitions. However, through detailed analysis of the medical documents—particularly the respondent’s long-standing history of smoking and moderate alcohol consumption since 1993—Ms. Arora successfully distinguished this case from others.
Presenting this crucial aspect before the Hon’ble Delhi High Court, she argued that the disease was not clearly attributable to military service. The Hon’ble Court was convinced and accordingly:
• Admitted the writ petition, and
• Granted stay on the operation of the Tribunal’s order.
